Family Law

Some of the most emotional, stressful experiences in life are associated with Family Law legal issues. Issues surrounding divorce, custody, guardianship, and adoption can not only be stressful, but overwhelming for those not familiar with the legal process. This can be especially true when considering domestic violence and Protective Order Hearings, where a Judge may award temporary custody, emergency family maintenance and even temporary use and possession of the family home. A lawyer can help in these difficult situations to evaluate the legal issues in your case and ensure that your rights are protected. At the Law Office of Timothy C. Marsheck, we are not only here to help you navigate through the legal process, but to advocate and protect your interests.

Frequently Asked Questions
In Maryland, certain statutory requirements must be satisfied prior to the granting of a final, Absolute Divorce. These requirements differ and are dependent upon the circumstances of the marriage. These circumstances include: adultery, separation for a period of one year, as well as several others. A knowledgeable family law attorney can discuss these issues and assist with next steps.
If spouses do not come to an Agreement as to how marital property should be distributed at the time of divorce, a Court will equitably distribute marital property when considering multiple statutory factors, including:
  • Duration of the marriage;
  • Age of the spouses;
  • The physical and mental condition of each spouse; and
  • Contributions, both monetary and non-monetary, of each spouse
A Court considers additional statutory factors when distributing marital property. A family law attorney can assist by evaluating circumstances and marital property in light of these statutory factors.
Physical custody refers to the time the minor child spends with each parent. In particular, the amount of overnight care each parent has with the minor child. Physical custody directly impacts the amount of child support awarded by a Court. In Maryland, physical custody of a minor child between parents is generally identified between primary physical custody or shared physical custody of a minor child.
Legal custody refers to the legal decisions made by parents for the minor child. Legal decisions include those relating to education, religious upbringing and medical decisions. In Maryland, legal custody of a minor child between parents is generally identified as sole legal custody, joint legal custody, and joint legal custody with tiebreaker authority.
